FAMILY LAW
Divorce and
Separation |
No one wants to hire a divorce lawyer. But the fact
is that millions of people go through unpleasant
divorce and separation proceedings every year.
Even though divorce and separation are often
emotionally stressful and costly, the experience
does not have to be a frightening and lonely. The
right attorney will guide you through the many
issues and challenges. In contrast, retaining the
wrong lawyer is extremely costly; more likely to
result in an adverse result.
Legal separation is a court order establishing the
terms of support, custody, etc. under which a
married couple will live separately.
Divorce is the legal dissolution of a marriage. A
divorce can be “contested” or “uncontested”.
A divorce is considered “contested” if the parties
cannot agree on all issues including the division of
property, debt, alimony, child custody, visitation,
etc. A contested divorce generally takes longer to |
|
resolve and is more expensive to settle.
A divorce is usually considered “uncontested” if
both spouses agree on how to divide their marital
property and debt and the custody, support and
visitation of minor children. Uncontested divorce
generally reduces stress, time and the financial
cost of divorce proceedings.
However, even in a uncontested divorce, both parties
should have their own attorney. This law firm will
not represent nor advise the client's spouse if he
or she is unrepresented. We communicate directly
with the client's spouse's attorney only. If the
spouse is unrepresented, then he or she is
considered a pro-se litigant and treated the same as
an opposing attorney.
Even in a uncontested divorce, the use of a quality
attorney is important. The improper preparation of
all of the divorce documents can delay your divorce.
A poorly drafted settlement agreement may cause
significant problems in the future.
