Custody and visitation rights
In Georgia the law is clear when it comes to the
rights of grandparents or great-grandparents.
Grandparents may be granted partial physical and
legal custody and/or visitation rights to a child or
children:
- when a parent is deceased
- when a parent’s marriage is
dissolved or the parents are separated
- when child has resided with
grandparents or great-grandparents for
12 months or more
- in cases involving ineffectual
parenting (parents in jail, substance
abuse, etc.).

Legal rights for “substitute parents”
Grandparents raising grandchildren face significant
obstacles in their role as “substitute parents.” In
addition to the social and economic challenges,
grandparents must also deal with a complicated set
of legal issues when they do not have legal custody
of the grandchildren they are raising. Grandparents
who are also caregivers need effective advocacy.
Deering & Associates has extensive experience
petitioning the courts for the legal rights and
needs of grandparents who have become primary or
occasional caregivers. We are experienced in
grandparents’ rights issues including:
- Guardianship subsidies
- Respite care
- Medical consent laws
- Educational consent laws
- De facto custodian laws
- Standby guardianship laws
